These Terms and Conditions (hereinafter: 'Terms') govern the use of the website solventaris.com and services provided by Solventaris d.o.o. By using our platform, you accept these Terms in their entirety.
1. Definitions
• 'Platform' — the website solventaris.com and all related digital services • 'User' — any natural or legal person accessing the Platform • 'Investor' — a registered User participating in crowdfunding projects • 'Project' — a construction or investment project published on the Platform • 'Project Owner' — a legal entity seeking financing through the Platform
2. Access and Registration Requirements
Registration is not required for basic Platform functions. To participate in crowdfunding projects, you must: • Be of legal age (18 years or older) • Have residence in the Republic of Croatia or another EU/EEA country • Possess a valid identification document • Provide accurate and complete personal data • Accept these Terms and the Privacy Policy
3. Service Description
Solventaris provides a digital real estate crowdfunding platform that enables: • Browsing available investment projects in the real estate sector • Participating in collective financing of selected projects • Tracking the progress of projects you have invested in • Receiving information about results and profit distribution Solventaris acts as an intermediary between investors and project owners. We do not guarantee the success or profitability of any project.
4. Investment Risks
Investing in real estate through crowdfunding involves significant risks: • Capital loss risk: you may lose part or all of your invested amount • Liquidity risk: investments typically cannot be withdrawn before project completion • Market risk: real estate values may decline • Delay risk: projects may be delayed or not completed as planned • Regulatory risk: legislative changes may affect projects We recommend investing only funds you can afford to lose and diversifying your investments.
5. Fees and Costs
Solventaris charges the following fees: • Management fee: 1.5 – 3% annually of the invested amount (depending on the project) • Success fee: 10 – 20% of profit achieved above the minimum threshold • Registration fee: free All fees are clearly stated in each project's documentation before investing. Additional costs (bank transfers, etc.) are listed in the price list.
6. Intellectual Property
All content on the Platform, including text, graphics, logos, photographs, software, and design, is protected by copyright and is the property of Solventaris d.o.o. or our licensors. Copying, distributing, or modifying content without written permission is prohibited.
7. Limitation of Liability
Solventaris is not liable for: • Losses arising from investing in crowdfunding projects • Platform interruptions due to technical issues or maintenance • Actions or omissions of project owners • Accuracy of information provided by project owners • Damage caused by unauthorized access to your user account Our total liability is limited to the amount of fees you have paid us in the last 12 months.
8. Termination and Cessation of Use
You may stop using the Platform at any time. Closing your account does not affect your existing investments, which remain active until project completion. Solventaris reserves the right to suspend or close your account in case of: • Violation of these Terms • Suspicion of fraud or money laundering • Providing inaccurate data • Inactivity exceeding 24 months
9. Governing Law and Dispute Resolution
These Terms are governed by the laws of the Republic of Croatia. For all disputes arising from the use of the Platform, the competent court in Zagreb, Republic of Croatia, shall have jurisdiction. Before initiating legal proceedings, the parties commit to attempting amicable resolution within 30 days. For consumer disputes, the EU online dispute resolution platform (ec.europa.eu/consumers/odr) may be used.
10. Changes to Terms
Solventaris reserves the right to amend these Terms. We will notify registered users of significant changes via email at least 30 days before they take effect. Continued use of the Platform after changes constitutes acceptance of the new Terms.
